Pre-Wedding Consultation

This normally happens at the time of booking.

  • The bride and groom will outline broadly what is required
  • The Photographer will advise on planning, logistics and timings where needed
  • The Photographer will contact you during the week before the wedding to ensure there have been no last minute changes
  • If preferred, the bride and groom are welcome to arrange a chat in person, near to the time of the wedding, to discuss any remaining details

The Booking Details

  • The bride and groom agree that they are responsible for providing all of the correct details regarding the date, time and each address the Photographer should attend
  • They also agree that they have responsibility to ensure the accuracy of all building names, street, road and postcode details
  • If the Photographer arrives at a postcode, building, street or address given by the couple, the Photographer will be deemed to have arrived at the correct address

Cooperation

  • The bride and groom and the Photographer consent to cooperate and communicate with each other in good spirits, to achieve the best possible result within the understanding of this contract
  • It is recommended that the Photographer is allocated a helper, usually the best man, who will point out key individuals to be photographed
  • The Photographer may require the assistance of the best man in organising family groups
  • The bride and groom agree to give the Photographer sufficient warning of key events at the wedding to give time to prepare, for example bouquet throwing, cutting the cake, speeches
  • Not all guests like having their photo taken and the Photographer will always use discretion but cannot be held responsible for a lack of photos of these people
  • Due to weather conditions and the willingness of subjects it may not be possible to capture all photographs requested

Guest Photography

  • Guests may take photographs at the wedding and reception
  • All formal or other shots set up by the Photographer will be required to be photographed solely by the Photographer
  • This ensures the photographs are of a consistently high standard
  • The Photographer cannot be responsible for unusable shots due to distractions from guests, for example eyes pointing in multiple directions
  • The Photographer requires a minimum of 25 minutes away from guests to produce artistic bride and groom shots
  • It is the responsibility of the bride and groom to inform their guests of this policy and ensure they comply

The Timetable

  • Punctuality and cooperation are essential in order to produce outstanding photographic results
  • In cases where the wedding does not run on time it cannot be guaranteed that time or light will remain available to capture all photographs agreed upon
  • The Photographer will document the events in a candid manner and take formal portraits where necessary
  • The bride and groom are responsible for providing a full list of formal photographs required, including names and relationships
  • There shall be no photography during the wedding breakfast
  • Photographs will not be taken while guests are being served their meal or while they are eating
  • Photography will resume for the toasts and speeches

Imposed Limitations

  • The Photographer may be limited by rules imposed by registrars, ministers and venue management
  • Photography may be disallowed in certain parts of a venue or during the wedding service
  • The bride and groom agree to discuss the impact of such limitations with the Photographer
  • It is advised that the bride and groom make themselves aware of the rules of the venue, church or minister and negotiate where necessary

Ownership, Rights and Responsibilities

  • The bride and groom will be supplied with a license to reproduce and copy photographs for personal, non-commercial purposes only
  • The bride and groom grant the Photographer the irrevocable and unlimited consent to use photographs for editorial, competition, advertising and promotional purposes
  • This includes use on the internet or transmission by electronic means
  • The copyright of the photographs belongs exclusively to the Photographer in accordance with the UK Copyright Act 1988

Payment Requirements

  • A non-refundable and non-transferable deposit of £250.00 is required to reserve the wedding date
  • A date will not be considered reserved without receipt of this payment
  • The deposit is not refundable for any reason unless the Photographer cancels this contract
  • The remaining balance must be received by the Photographer no later than 12 weeks prior to the date of the wedding
  • Cheques should be made payable to “Scott’s of Cambridge”

Cancellation and Late Bookings

  • If the Photographer has to cancel this contract for any reason, liability shall be limited to a full refund of all monies paid
  • Cancellation may be given in writing only
  • If notice is more than 12 weeks before the date of the wedding, no charge applies other than forfeiture of the deposit as compensation for loss of income
  • If notice is given less than 12 weeks before the wedding date, payment must be made in full at the time of cancellation
  • Cancellation will not be considered given until payment is received
  • If the Photographer secures another wedding booking for the cancelled date, a full unconditional refund of deposit and monies paid will be made
  • Last-minute bookings made less than 12 weeks in advance must be paid for in full upon booking
  • All cancellations are subject to this policy

Complaints

  • Any complaints should be raised in writing within 21 days from the date of receipt of images
  • In the event of an unresolved complaint, mediation may be requested through the Society of Wedding and Portrait Photographers
  • Any decision reached through mediation shall be final and binding upon both parties

Privacy Statement

  • Any and all personal information will be kept strictly confidential
  • Personal data will not be sold, reused, rented, disclosed or loaned to any other companies or individuals
  • All information will be held with the utmost care and will not be used in ways to which the bride and groom have not consented

Postage

  • DVDs of images will be posted first class recorded delivery free of charge to any UK address
  • Delivery will require a signature on receipt
  • The DVD will be posted to the address currently held
  • It is the responsibility of the bride and groom to inform the Photographer of any change of address
  • Overseas postage or second attempt postage charges must be covered in full prior to posting
  • All postage charges for albums and prints must be covered by the customer at the time of ordering
  • All overseas album postage charges must be covered in full by the bride and groom

Images

  • The waiting time between the wedding date and receipt of images may be up to 8 weeks
  • All images are supplied at high resolution on CD or DVD
  • The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching
  • Certain dyes and materials may cause anomalous reflectance
  • It is sometimes impossible to record digitally the exact colour as seen by the human eye

Wedding Books

  • All wedding books must be paid for in full before any design work begins
  • Wedding books ordered at the time of booking require image selection within six months of receipt of the CD or DVD
  • Image selections must be provided as a list of file numbers via email
  • Wedding books ordered after the wedding are designed subject to the Photographer’s available time
  • Ordering between late October and late March is advised for quicker turnaround

Disclaimer and Jurisdiction

  • Every effort will be made to provide high quality photographic services
  • In the event of catastrophic mechanical failure of equipment or transport, liability is limited to a full refund of all monies paid
  • The Photographer holds full Public Liability and Professional Indemnity Insurance
  • This agreement is governed by UK Law

Additional Standard Terms

Force Majeure

The Photographer shall not be liable for failure to perform services due to circumstances beyond reasonable control, including acts of God, government restrictions, strikes, fire, flood, pandemic or severe weather.

Limitation of Liability

Any liability is limited to the total amount paid under this contract. No claim shall exceed this amount.

Digital File Storage

The Photographer does not guarantee long-term storage of digital files after delivery. Clients are advised to back up all files upon receipt.

Image Style and Editing

The client accepts the Photographer’s style, artistic interpretation and editing approach. Re-editing requests are not guaranteed.

Third-Party Suppliers

The Photographer is not responsible for the performance, actions or failures of third-party suppliers or venues.

Website and Online Galleries

Online galleries or download access may be time-limited and are provided at the Photographer’s discretion.

Assignment of Contract

This contract may not be assigned or transferred without written consent from the Photographer.

Severability

If any provision of these terms is found unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties and supersede all prior discussions or agreements.
